What this measure does

A twenty-five bed Level 1 general hospital is established in Northern Kabuntalan. The regional health ministry supervises it, approves its structure, formulates its operating guidelines within 90 days, and — expressly — ensures funding for the building itself, the complementary infrastructure, the medical equipment, the maintenance and the personnel.

Where the act departs from its siblings is Section 4. The Ministry of Health assumes *full* responsibility for the hospital's financial management to begin with: budget allocation, procurement, expenditures. Then a phased transition plan is to move that management to the municipality — in stages, against benchmarks, with the Ministry conducting regular evaluations of whether the local government has demonstrated sufficient capacity, including compliance with accounting standards, efficient procurement practices and budgetary discipline. Full financial control passes only after assessments focused on local governance, accountability and the sustainability of healthcare service delivery.

The site is chosen jointly with the municipality rather than imposed. Fifty million pesos is appropriated from the 2025 budget.

To give the municipality a hospital, and to answer a question the region's other health acts leave alone: who should be running these facilities in the long run.

Funding

Carries an appropriation. ₱50,000,000 initial, charged against the Miscellaneous and Personnel Benefit Fund of the 2025 General Appropriation Act of the Bangsamoro, with subsequent operations in the annual appropriations. The Ministry is separately directed to ensure funding for construction, infrastructure, equipment, maintenance and personnel.

What to notice

Section 4 is the most thoughtful provision in the region's hospital legislation. Devolution of health facilities usually happens in one of two bad ways: everything is handed to a local government that cannot yet run it, or nothing ever is and 'local autonomy' remains rhetorical. This act does neither. It starts the hospital under regional financial control, sets an explicit intention to transfer, and makes the transfer conditional on demonstrated capacity — accounting standards, procurement practice, budgetary discipline — assessed on a rolling basis.

The weakness is that a conditional commitment with no deadline and no defined benchmarks can also become a permanent excuse. The act does not say what the benchmarks are, who sets them, how often the evaluations happen, or what the municipality can do if it believes it has met them and control is withheld. The judge of the LGU's readiness is the same ministry that would give up the budget.

One error should be flagged plainly. Section 3 directs consultation with 'the LGUs of the Province of Maguindanao del Sur' — but Northern Kabuntalan is in Maguindanao del Norte, as the act's own title says. It appears to be a drafting slip carried into the signed text. This registry reproduces it rather than silently correcting it, because the enacted words are the ones that govern.
